A shocking legal case in England has awarded a defendant £55,000 in damages recently. In a bizarre case of dental negligence and malpractice, a dental patient has recently settled a medical negligence claim against English dentist, Dr. Lupin. The patient, a 64-year-old woman from Kent, England, claims to have faced widespread tooth and bone decay, as well as losing 15 teeth, due to poor dental care from her dental provider.
The patient claimed in her dental negligence case against Dr. Ashley Lupin that the dentist failed to provide an acceptable level of dental care, which led to the loss of 15 teeth in a 30-year time span. Despite visiting Dr. Lupin for at least 50 routine dental visits and receiving many procedures such as root canals, extractions and crowns, and fillings, the patient was forced to undergo widespread restorative treatment of her teeth costing more than £8,000.
Allegations against the dentist claim that he constantly re-cemented loose crows and prescribed antibiotics for infections without investigating the underlying causes of the ailments to the patient. The patient claims that over the 30 year period of appointments that she was assured that there was nothing out of the ordination and that there was nothing wrong. After many years of seeing the dentist, the patient discovered a lump under her nose which the doctor claimed to be nothing more than a boil and casually prescribed more antibiotics.
The boil, which the patient seemed to have under control, persisted for years. It wasn’t until one of the dentist’s faulty crowns fell out that the patient rang another oral surgeon nearer to her house. This new dentist immediately alerted the patient of major damages to her teeth and mouth and informed her that several of her teeth were beyond the point of saving. After sending the patient for emergency x-rays, the new dentist informed the patient of an abscess that had formed under the faulty crown and eroded her bone away.
Eventually, the new dentist was able to remove the abscess safely, but not without any casualties. The patient, at this time, had already lost six teeth and was forced to endure losing nine more due to gum disease that had gone untreated. The poor dental work and the complete negligence that she had received from Dr. Lupin had affected her life, her work, her ability to eat, and her financial situation. The patient reached out to English firm Hudgell Solicitors to bring her claim against Dr. Lupin for medical negligence to court.
They were able to settle the claim with Lupin and the patient was awarded a sum of £55000. The most shocking part about this case is that the patient regularly attended appointments twice a year from 1982 to 2014 without being notified of any damages or issues with her oral health. Solicitors were shocked at the amount of negligence, saying it was one of the worst cases of this nature they have ever encountered. “Oral and physical health has the ability to affect people psychologically. It has a big impact on the quality of your life. 30+ years of negligence to a patient that trusts and pays a doctor to help them take care of themselves should not be allowed.”
